Small Estate Affidavit
Also called an affidavit for collection of personal property.
A small estate affidavit is a form that lets heirs collect a person's property without probate when the estate is small.
In Utah
- The estate must be worth $100,000 or less, after certain deductions.
- At least 30 days must have passed since the death.
- It can’t be used to transfer a house or land.
You give the signed affidavit and a death certificate to whoever holds the property, such as a bank.
